Sale of Tickets for Festival Events – Terms & Conditions

The Ticket is issued for the Festival Event by the Promoter subject to the following Terms & Conditions which govern the issue and use of the Ticket; and the basis on which the Bearer is permitted to enter and remain within the Venue:

1. The use of the Ticket shall constitute acceptance by the Bearer of these Terms & Conditions and imply an undertaking on the part of the Bearer to observe them and any other notice or regulation issued by the Promoter and displayed at the Venue.

2. No Glass is permitted to be brought in anywhere in the Venue.

3. No Dogs or other animals are allowed in the Venue.

4. All children under 16 must be accompanied by an adult.

5. Smokers are asked to use the designated smoking area. 

6. Please respect the Venue, use the rubbish disposal facilities provided or take your waste away with you.

7. Respect those living near the Venue and minimise noise when you leave. No alcohol purchased at the Venue is to be consumed as you leave.

8. The Promoter reserves the right to search all people and personal property upon entry to and while at the Venue. Glass items, barbecues, candles, gas canisters, flares, knives, illegal substances, drugs, ‘legal highs’, laser equipment/pens, megaphones, nitrous oxide, animals, fireworks, smoke canisters, poles, banners or flags, drones and any items which in the absolute discretion of the Promoter are considered to be a risk to the safety of the audience and/or affect the enjoyment of the audience and/or the running of the event are prohibited.

9. Proof of age may be required on entry for concessionary tickets. Please ensure that you have ID with proof of age in case you are asked. Failure to provide such ID may result in your young person being asked to pay adult ticket price.

10. The Bearer may bring a portable seat into the Venue for their own use but must follow instructions from the Promoter or their representative so that the use of it does not create any health and safety issues. 

11. Adults are reminded that there are areas of the Venue, especially immediately in front of the stage; and that some bands or acts may contain adult content; that may be inappropriate for children. If you bring children with you, the responsibility for their safety and welfare lies entirely with you.

12. Any equipment capable of recording (whether temporarily or permanently) or transmitting any audio- or audio-visual material is prohibited. Mobile phones and photographic equipment are permitted but only for personal non-commercial use. In the event of subsequent commercial use, the Bearer agrees to pay the Promoter the cost of a licence issued by the Promoter for permission to take photographs or visual/audio visual/audio recordings for commercial use.

13. The Promoter reserves the right to refuse admission to the Venue or eject any person from the Venue if, in the absolute discretion of the Promoter or the Promoter’s representative:
• the Bearer may be a risk to the safety of the audience and/or the enjoyment of the audience and/or the running of the event; and/or 
• the Bearer refuses to be searched upon entering the Venue, appears to be under the influence of drink and/or drugs and/or is acting aggressively or in possession of any items prohibited under the Terms & Conditions or fails to comply with any lawful instruction issued by or on behalf of the Promoter. 

14. The Promoter reserves the right not to refund the cost of a Ticket to any Bearer who is refused entry or ejected under point 13.

15. The Promoter reserves the right to alter or change the programme without prior notification. Refunds will not be issued should the programme be altered or if a particular artist does not appear, including headline acts.

16. Tickets cannot be exchanged or refunded after purchase unless the event is cancelled; in which case you will be offered tickets to any rescheduled event (subject to availability) up to the face value of the Ticket; or if you are unable to attend the rescheduled event or if the event is not rescheduled, a refund to the face value of the Ticket.

17. If the event is cancelled, the Promoter shall not be liable for any costs or expenses incurred by the Bearer including, but not limited to, accommodation or transport costs or any direct or indirect losses or damages of any kind.

18. The Bearer gives their irrevocable and free of charge express consent to the use of their actual or simulated image, voice, or likeness in connection with the advertising, promotion, or commercial exploitation of the Festival Event or any past or future Festival Event by the Promoter or any licencee of the Promoter for any media, for any period, throughout the world.

19. The Ticket will not permit access to any platform, disabled enclosure, or backstage area.

20. Any breach of the Terms & Conditions will render the Ticket automatically void and all rights conferred or evidenced by such Ticket shall be withdrawn without any refund. For the avoidance of doubt, this will include refusal of entry to the Venue or ejection from the Venue as applicable.

21. Admission to the Venue is at the Bearer’s own risk to the maximum extent permitted by law. The Promoter hereby excludes any liability for loss, injury or damage to persons or property in or around the Venue before, during or after the event.

22. These Terms & Conditions are governed by English Law. Any dispute arising out of or in connection with them shall be subject to the jurisdiction of the English Court.

23. Definitions 
In these Terms & Conditions, the following words and phrases shall have the following meanings:
a. Bearer means the holder of the Ticket.
b. Ticket means any paper or electronic ticket or wristband (as applicable) issued for the Festival Event (whether or not for value) by the Promoter.
c. Promoter means Arundel Music Festival or Arundel Festival of the Arts or Arundel Festival Ltd, registered charity 1136508, 51 High Street, Arundel BN18 9AJ and where the context requires, those acting on its behalf such as stewards and security guards.
d. Venue means the venue advertised for the Festival Event.
